TERMS AND CONDITIONS OF THE LOFALO ONLINE STORE

1. GENERAL PROVISIONS

  1. These Terms and Conditions define the rules of operation, the types and scope of services provided electronically via the https://lofalo.com/ online store, the terms for the provision of such services, the conditions for concluding and terminating service agreements and Sales Agreements, as well as the complaint procedure.

  2. The online store available at https://lofalo.com/ is operated by Lofalo Monika Bukowiec, registered in Zegartowice, address: Zegartowice 160, 32-415 Raciechowice, Poland, NIP: 7371813586, REGON: 121428603, represented by: Monika Bukowiec, phone: +48 12 271 52 23, e-mail: lo@lofalo.com.

  3. Any User using the services of the Store at https://lofalo.com/ is obliged to comply with these Terms and Conditions.

  4. In order to place an order, the Customer must read and accept these Terms and Conditions at the time of order placement.

  5. The Store https://lofalo.com/ sells products online within Poland and other European Union countries.

  6. The products offered in the Store are new, free from legal defects, and legally introduced to the Polish market.

  7. The offered furniture is delivered in packages for self-assembly by the Customer. Assembly instructions and necessary parts are included.

  8. All trade names, product names, company names, and logos shown on https://lofalo.com/ belong to their respective owners and are used solely for identification purposes. They may be registered trademarks. All materials, descriptions, and images on the website are for informational purposes only.

  9. In matters not covered by these Terms, the following regulations apply:
    a) Act on the Provision of Electronic Services of July 18, 2002 (Journal of Laws 2020, item 344),
    b) Consumer Rights Act of May 30, 2014 (Journal of Laws 2020, item 287, as amended),
    c) Civil Code of April 23, 1964 (Journal of Laws 2022, item 1360, as amended),
    d) and the Store’s Privacy Policy available at: lofalo.com

2. DEFINITIONS

Terms used in these Terms and Conditions mean:

  • BUSINESS DAY – a day from Monday to Friday, excluding public holidays.

  • CONSUMER – a natural person making a legal transaction with the Seller not directly related to their business or professional activity; or a person concluding a contract directly related to their business, where the contract does not have a professional character based on CEIDG registration.

  • CUSTOMER – a User who has concluded or intends to conclude a Sales Agreement with the Seller.

  • ACCOUNT – an individual account in the Seller’s system assigned by login and password, containing the Customer's data and order history.

  • TERMS AND CONDITIONS – this document.

  • STORE – the online store operated at https://lofalo.com/

  • SELLER / SERVICE PROVIDER – Lofalo Monika Bukowiec, Zegartowice 160, 32-415 Raciechowice, Poland, NIP: 7371813586, REGON: 121428603, represented by Monika Bukowiec, phone: +48 12 271 52 23, email: lo@lofalo.com

  • PRODUCT – a movable item or service available in the Store, which is the subject of the Sales Agreement.

  • SALES AGREEMENT – a product sales agreement between the Customer and the Seller via the Store.

  • USER – any individual or entity using the Store’s electronic services.

  • ELECTRONIC SERVICE – a service provided electronically by the Seller to the User via the Store.

  • ORDER – a Customer’s declaration of intent to conclude a Sales Agreement.

  • DISTANCE AGREEMENT – a contract concluded with a Consumer via remote communication tools without physical presence of both parties.

3. TYPE AND SCOPE OF ELECTRONIC SERVICES

  1. The Store provides the following free electronic services:
    a) Conclusion of Product Sales Agreements,
    b) Newsletter subscription.

  2. Services are provided under the conditions outlined in these Terms.

  3. The Seller may display advertisements on the Store website. These are an integral part of the Store.

  4. Technical requirements to use the Store:

    • Internet-enabled device,

    • Email access,

    • Web browser,

    • Enabled cookies and JavaScript.

  5. Users must use the Store lawfully and ethically, respecting intellectual property and privacy.

  6. Users must provide accurate personal data. Providing illegal content is prohibited.

  7. Continuous electronic services (e.g. maintaining an account) may be terminated.

  8. The User may terminate the agreement immediately without giving reasons by sending an email to: lo@lofalo.com

4. RULES FOR CONCLUDING SALES AGREEMENTS

  1. Product information on the website does not constitute an offer in the legal sense. Placing an order is a purchase offer.

  2. Product prices are in Polish zloty (PLN), include VAT and other charges, but exclude shipping costs.

  3. The product price at the time of ordering is binding and won’t change afterward.

  4. An account is not required to place an order.

  5. Orders may be placed via the Store's website at https://lofalo.com/ 24/7 all year round.

  6. Orders are processed Monday to Friday, 7:00–15:00 (business hours). Orders after 15:00, on weekends or holidays are processed on the next business day.

  7. To conclude a Sales Agreement, the Customer must place an Order using the available methods.

  8. After order placement, the Seller immediately confirms receipt and acceptance via email containing:

    • Order summary,

    • Notice of the right of withdrawal,

    • These Terms and Conditions.

    The contract is concluded once the Customer receives this confirmation email.

  9. Every Sales Agreement is confirmed by a VAT invoice sent to the provided email. By accepting these Terms, the Customer agrees to receive invoices electronically.

  10. If billing data differs from account data, the Customer must update the "Billing Details" section accordingly.

  11. For company invoices, the "Company Name" and "VAT Number" fields must be completed. Otherwise, an invoice cannot be issued to a company.

5. PAYMENT METHODS

  1. Payment options:
    a) Bank transfer,
    b) Cash on delivery (COD),
    c) Online payment systems (Przelewy24.pl).

  2. For online payments, payment must be completed before order fulfillment. Products are dispatched after payment is confirmed.

  3. Payment must be made within 3 business days unless otherwise agreed. Production of custom-made furniture begins only after payment.

6. DELIVERY COST, TIME, AND METHODS

  1. Products are shipped via courier.

  2. Personal pickup is available at: Zegartowice 160, 32-415 Zegartowice, Poland.

  3. Delivery time includes:

    • Product preparation (production),

    • Courier shipping time.

  4. Domestic delivery (Poland): up to 5 business days (excluding weekends and public holidays).

  5. If ordering several items with different production times, the longest time applies.

  6. If packaging is damaged upon delivery, the Customer should inspect the product and request a damage report from the courier.

  7. International delivery:

    • Delivery time is determined individually and follows the courier’s waybill.

    • The Customer will be informed about the delivery time and shipping cost before completing the order.

  8. Production time is no more than 2 weeks, regardless of the destination.

7. PRODUCT QUALITY AND WARRANTY

  1. Product appearance (colors, dimensions, welds) may slightly differ from the online images. Dimensional tolerance:

    • ±2 cm if dimensions ≤ 150 cm,

    • ±2.5 cm if dimensions > 150 cm.

    • Tolerance for weld thickness: ____________________. Weld visibility may vary depending on product color.

  2. Some products come with a 12-month warranty valid in Poland.

  3. Warranty period starts on the date of delivery.

  4. Proof of purchase (receipt or VAT invoice) is required to make a warranty claim.

8. COMPLAINT PROCEDURE

  1. Warranty liability is excluded for non-Consumer clients. Consumers are protected under the Consumer Rights Act.

  2. Complaints can be submitted via email: lo@lofalo.com or by mail.

  3. The complaint should include details of the issue, date, and contact info.

  4. If necessary, the Product must be sent to: Zegartowice 160, 32-415 Zegartowice.

  5. The Consumer may request repair or replacement. The Seller may choose the alternative if the requested option is unfeasible or too costly.

  6. The Consumer may request a price reduction or withdrawal from the contract if:
    a) The Seller refuses to restore compliance,
    b) The issue persists after an attempted fix,
    c) The non-compliance is significant,
    d) The Seller has not acted in a reasonable time.

  7. Complaints are processed within 14 days. If no response is provided within this period, the complaint is considered accepted.

  8. The Seller covers the costs of returns and replacements for justified complaints.

  9. If damage is found upon delivery, a damage report should be completed immediately.

9. RIGHT TO WITHDRAW FROM THE CONTRACT

  1. Consumers may withdraw from a distance contract within 14 days without giving a reason by submitting a declaration to the Seller.

  2. Upon withdrawal, the contract is considered null, and both parties must return what was exchanged.

  3. The Consumer is liable for diminished product value due to improper use.

  4. Refunds will be made using the original payment method, unless otherwise agreed.

  5. If a more expensive delivery option was chosen, the Seller refunds only the cost of the standard method.

  6. The 14-day period starts when the Consumer receives the product.

  7. No right of withdrawal applies to:
    a) Custom-made (non-prefabricated) products,
    b) Services completed with Consumer’s consent and prior notice of withdrawal rights loss.

  8. Either party may withdraw if the other fails to meet a clearly defined deadline (e.g. delayed delivery).

  9. All furniture is custom-made based on the Consumer’s specifications and is not eligible for withdrawal, in accordance with Article 38(1)(3) of the Consumer Rights Act.

10. FINAL PROVISIONS

  1. All content on https://lofalo.com/ is protected by copyright and may not be used without written consent from the Seller.

  2. Contracts concluded via the Store are governed by Polish law.

  3. If any part of these Terms is found unlawful, the relevant legal provision will apply instead.

  4. Disputes should be resolved amicably. If that’s not possible, the appropriate court will handle the case.

  5. Jurisdiction:
    a) Disputes with Consumers are handled according to Polish civil procedure law.
    b) Disputes with business Clients are handled by the court of the Seller’s registered office.

  6. Consumers can seek help from consumer protection organizations or ombudsmen.

  7. Consumers may also use the EU’s ODR platform for online dispute resolution:
